Ben, you were a challenging adversary who zealously asserted your client's interest, and compelled me to do likewise with my client. We finally reached a good out-of-court settlement.
Rest in Peace!

It was always a good day when Ben came to court, because chances just improved on having an (all too rare) actual conversation for a little while until he had to go in. No matter the topic or societal issues we were discussing or ranting about at the time, Ben's world views always came from an enlightened, intelligent and innately decent mindset. He gave me a book once that everyone should read called "Desk 88," that personifies to a t who Ben was and where he was coming from
Heartbroken condolences to his family and friends, and to everyone who had the good fortune to know him. I'll always miss him.

I have had the fortune to know Ben as an attorney who appeared in my court occasionally as well as a fellow republican. Ben was always available to those who asked for advice or help. He seemed very happy in his chosen profession and adored his family.
I am deeply sorry to hear of his passing. Thinking of his family at this very painful time.

My condolences to the family at this difficult time. I came to know Benny at Alfred University. I was the Head Athletic Trainer, I had daily contact with him in the athletic training facility tending to his his many football related bumps and bruises, some physical and some psychological...Ben was on the football team, a dynamic and spirited player, a class act. His wonderful personality belied his intensity as a competitor...it surprises me none of his successes beyond Alfred...Gene Castrovillo, former Head Athletic Trainer, Alfred University 1969-1980

I am saddened to hear of Ben’s passing. My deepest sympathies to the Ostrer Family & Friends. Ben represented the old couple we bought our first house from in 1989. He impressed me then, as a young newlywed. He later became a client at my Barbershop. He was always a polite and thoughtful Gentleman. Loved the ball game on in the shop. Intelligent conversationalist. We need more Men like Ben in our world. I am happy I got to spend those short moments together with Him.
Warmest Sympathies,
Chris Conte

Ben and I worked together over the years on several cases. I have know him to be a caring advocate for his clients. Over the years when I had questions I would reach out to Ben and he always offered me guidance. He will be missed by all that know him. He was very well respected in the legal community and rightly so. He will be missed by all that know him.

I had the pleasure of trying cases with Ben on the other side. He always brought his A game and made me a better advocate as a result. Most recently, we worked together on the NYS Bar Association Criminal Justice Section Executive Board. He was a great lawyer and a true gentleman. He will be sorely missed.
Sincerely,
Jonah Triebwasser,

Ben was the man I chose to be the lawyer for my daughters who were victims of horrific crimes in their childhoods, and had the opportunity to get some power back by suing the perpetrator after he won a lawsuit related to his imprisonment. Not only did Ben go above and beyond to get my girls every penny they could get, he made them feel comfortable and safe, and treated them as a father would treat his daughters. Not only did Ben win the case, he refused to take his percentage of the monetary award. When we protested, he said they have been through enough, I want them to get every penny of this award. There are a lot of jokes about lawyers, but Ben at every point during this case was my girls’ hero. There are not enough words to express how we feel about Ben, and how heartbroken we are to hear of his passing. The world is a poorer place because of him not being in it. Our thoughts and prayers are with the family during this painful time.
